TERMS AND CONDITIONS OF SALE

This document regulates the terms and conditions of use of the site www.guerrerosporting.com (hereinafter, the "Site") and the purchase of products offered through it. The Site is managed by:

1. SUBJECT

These General Conditions of Sale govern the purchase of products offered by GVE SRL through the Site. By placing an order, the Customer fully accepts these conditions.

2. DEFINITIONS

Salesperson: GVE SRL.

Customer: any natural person (consumer) or legal entity who places an order through the Site.

Products: sporting goods and accessories for combat sports sold on the Site.

3. ACCEPTANCE OF TERMS

By placing an order, the Customer declares that he has read, understood and accepted these General Conditions of Sale.

4. PRODUCTS AND AVAILABILITY

The products on the Site are described with the greatest possible accuracy. The images are illustrative and may not faithfully represent the product. Availability is subject to change and does not guarantee actual availability at the time of ordering.

5. PRICES AND CURRENCY

All prices are in Euros and include VAT where applicable. Shipping costs are shown separately during the checkout process. For international orders, any customs duties, local taxes or other charges are the responsibility of the Customer.

6. PAYMENT METHODS

The following payment methods are accepted:

  • Credit/debit cards (Visa, Mastercard, American Express)

  • PayPal

  • Shopify Payments

  • Other methods may be indicated at checkout

7. SHIPPING AND DELIVERIES

The Seller ships to Italy, the European Union and non-EU countries. Delivery times are indicative and not binding. The Customer is responsible for providing a correct address. In the event of non-delivery due to causes attributable to the Customer, any redelivery costs will be at his expense.

8. RIGHT OF WITHDRAWAL (EU consumers only)

Pursuant to Directive 2011/83/EU and Legislative Decree 206/2005 (Consumer Code), the Customer has the right to withdraw from the purchase within 14 days of receiving the products, without having to provide a reason.

To exercise the right of withdrawal:

Return shipping costs are the responsibility of the Customer. The refund will be made within 14 days of receipt of the return.

Exclusions: The right of withdrawal does not apply to personalized, used, or non-returnable products for hygiene reasons.

9. LEGAL WARRANTY

The products are covered by a 24-month legal guarantee for defects of conformity pursuant to the Consumer Code. In case of problems, the Customer is required to contact the Customer Service.

10. USE AND LIMITATIONS OF PROTECTION PRODUCTS

The helmets, gloves and other protections sold on the Site are to be considered “light” protections, designed exclusively for light training activities and controlled sparring sessions, with reduced intensity.

These products are not designed or guaranteed to protect against high-intensity impacts, full-force blows, or full-blown combat. Using the products in ways that exceed the indicated limits may result in the protection not being effective and may present a risk of injury, damage, or breakage of the product.

The Customer acknowledges and accepts that the protective effectiveness of the products is limited and that use must be appropriate, responsible and in accordance with the instructions provided.

The Customer assumes full responsibility for any and all liability arising from:

  • improper use of the product;

  • use in training or combat with full power blows;

  • failure to comply with instructions and warnings regarding maximum intensity of use.

The Seller cannot be held responsible for any damage to persons or property resulting from use of the products that does not comply with these conditions or the instructions provided.

11. LIMITATIONS OF LIABILITY

The Seller is not responsible for delays or failures to deliver due to force majeure, unforeseeable events or events attributable to third parties. Any liability for any indirect damages is excluded.

12. INTERNATIONAL USERS

Users residing outside of Italy are responsible for compliance with local laws regarding the purchase and importation of products. The Site may be used only within the limits provided by the laws of the user's country.

13. PROCESSING OF PERSONAL DATA (PRIVACY)

The data provided by the Customer will be processed in compliance with EU Regulation 2016/679 (GDPR). For more information, please see our Privacy Policy.

14. INTELLECTUAL PROPERTY

All contents of the Site (brands, texts, images, graphics) are the property of GVE SRL or licensed and are protected by copyright and trademark laws.

15. APPLICABLE LAW AND JURISDICTION

These terms and conditions are governed by Italian law. In the event of disputes with consumers, the competent court is the court of the Customer's residence or domicile. For professional users or non-consumers, the competent court is the Court of Milan, unless otherwise provided by mandatory law.
